劳务派遣合同的种类和期限如何确定

劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong)分(fen)为(wei)固定期限(xian)劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong)、无固定期限(xian)劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong)和(he)(he)以(yi)完成一定工作任务为(wei)期限(xian)的(de)(de)(de)劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong)。用人单(dan)位和(he)(he)劳(lao)(lao)(lao)动(dong)者(zhe)(zhe)选(xuan)择订(ding)立什么(me)类型的(de)(de)(de)劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong),由(you)用人单(dan)位和(he)(he)劳(lao)(lao)(lao)动(dong)者(zhe)(zhe)协(xie)商决(jue)定。但是考(kao)虑到劳(lao)(lao)(lao)务派(pai)(pai)遣(qian)(qian)合同(tong)(tong)(tong)的(de)(de)(de)特(te)殊(shu)性(xing),为(wei)了(le)保护被(bei)派(pai)(pai)遣(qian)(qian)劳(lao)(lao)(lao)动(dong)者(zhe)(zhe)的(de)(de)(de)利(li)益,我(wo)国《劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong)法》第58条(tiao)对劳(lao)(lao)(lao)务派(pai)(pai)遣(qian)(qian)单(dan)位与被(bei)派(pai)(pai)遣(qian)(qian)劳(lao)(lao)(lao)动(dong)者(zhe)(zhe)订(ding)立的(de)(de)(de)劳(lao)(lao)(lao)动(dong)合同(tong)(tong)(tong)的(de)(de)(de)种类和(he)(he)期限(xian)做出了(le)特(te)别规定:

1.劳务派遣(qian)单(dan)位和被派遣(qian)劳动者只能订立固定劳动合同

无固(gu)定(ding)(ding)劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong)属于(yu)长(zhang)期(qi)(qi)劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong),要(yao)求劳(lao)(lao)务派遣(qian)(qian)单(dan)位与(yu)(yu)被(bei)派遣(qian)(qian)劳(lao)(lao)动(dong)(dong)者订(ding)立固(gu)定(ding)(ding)期(qi)(qi)限(xian)(xian)劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong)。以完成一定(ding)(ding)工作任务为(wei)期(qi)(qi)限(xian)(xian)的劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong)是(shi)短期(qi)(qi)劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong),与(yu)(yu)劳(lao)(lao)务派遣(qian)(qian)合(he)同(tong)(tong)有共同(tong)(tong)之(zhi)处(chu)。但是(shi),这种劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)限(xian)(xian)的不(bu)太明(ming)确(que),有可能使被(bei)派遣(qian)(qian)劳(lao)(lao)动(dong)(dong)者处(chu)于(yu)无工作状态,而且劳(lao)(lao)务派遣(qian)(qian)单(dan)位和以接受劳(lao)(lao)务派遣(qian)(qian)形式用工的单(dan)位的权利和义(yi)务难区分,增加了(le)管(guan)理难度(du)。固(gu)定(ding)(ding)期(qi)(qi)限(xian)(xian)劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong)的期(qi)(qi)限(xian)(xian)明(ming)确(que),权利和义(yi)务也(ye)好分清,为(wei)了(le)保护劳(lao)(lao)动(dong)(dong)者利益,劳(lao)(lao)务派遣(qian)(qian)单(dan)位与(yu)(yu)被(bei)派遣(qian)(qian)劳(lao)(lao)动(dong)(dong)者订(ding)立劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong),只能订(ding)立固(gu)定(ding)(ding)期(qi)(qi)限(xian)(xian)劳(lao)(lao)动(dong)(dong)合(he)同(tong)(tong)。

2.劳(lao)(lao)务派遣单位和被派遣劳(lao)(lao)动者订立的劳(lao)(lao)动合同期限(xian)必须在(zai)2年(nian)以上(shang)

劳(lao)(lao)务(wu)派遣(qian)(qian)(qian)单(dan)位(wei)和(he)被(bei)派遣(qian)(qian)(qian)劳(lao)(lao)动者(zhe)(zhe)订立的劳(lao)(lao)动合同(tong)期限无任何限制(zhi),将会使(shi)劳(lao)(lao)务(wu)派遣(qian)(qian)(qian)单(dan)位(wei)和(he)被(bei)派遣(qian)(qian)(qian)劳(lao)(lao)动者(zhe)(zhe)订立短期的劳(lao)(lao)动合同(tong),从而逃(tao)避其应当承担(dan)的法(fa)律责任。规定劳(lao)(lao)务(wu)派遣(qian)(qian)(qian)单(dan)位(wei)和(he)被(bei)派遣(qian)(qian)(qian)劳(lao)(lao)动者(zhe)(zhe)订立的劳(lao)(lao)动合同(tong)期限必须(xu)在(zai)2年以上(shang),可以防止劳(lao)(lao)务(wu)派遣(qian)(qian)(qian)单(dan)位(wei)逃(tao)避应当承担(dan)的法(fa)律责任。

《劳(lao)(lao)动(dong)(dong)合同法(fa)(fa)》第五十八条劳(lao)(lao)务派(pai)遣(qian)(qian)单位是(shi)本(ben)法(fa)(fa)所称用人单位,应(ying)当(dang)履(lv)行用人单位对劳(lao)(lao)动(dong)(dong)者的(de)义务。劳(lao)(lao)务派(pai)遣(qian)(qian)单位与(yu)被派(pai)遣(qian)(qian)劳(lao)(lao)动(dong)(dong)者订(ding)立(li)的(de)劳(lao)(lao)动(dong)(dong)合同,除应(ying)当(dang)载(zai)明本(ben)法(fa)(fa)第十七(qi)条规定的(de)事项(xiang)外,还应(ying)当(dang)载(zai)明被派(pai)遣(qian)(qian)劳(lao)(lao)动(dong)(dong)者的(de)用工(gong)(gong)单位以及(ji)派(pai)遣(qian)(qian)期限、工(gong)(gong)作(zuo)岗(gang)位等情况。

劳务派(pai)遣(qian)单位应(ying)当与被派(pai)遣(qian)劳动者订立二(er)年(nian)以上的固(gu)定期(qi)限劳动合同(tong),按月支付(fu)劳动报酬;被派(pai)遣(qian)劳动者在无工作(zuo)期(qi)间,劳务派(pai)遣(qian)单位应(ying)当按照所在地(di)人民政(zheng)府(fu)规(gui)定的最低工资标准(zhun),向其按月支付(fu)报酬。

第五十(shi)九条劳(lao)(lao)务(wu)(wu)派遣(qian)(qian)单位派遣(qian)(qian)劳(lao)(lao)动(dong)者应当(dang)与(yu)接受以(yi)劳(lao)(lao)务(wu)(wu)派遣(qian)(qian)形(xing)式用工的单位(以(yi)下称用工单位)订立劳(lao)(lao)务(wu)(wu)派遣(qian)(qian)协议。劳(lao)(lao)务(wu)(wu)派遣(qian)(qian)协议应当(dang)约定派遣(qian)(qian)岗位和(he)人(ren)员数(shu)量、派遣(qian)(qian)期限、劳(lao)(lao)动(dong)报酬和(he)社会(hui)保险费(fei)的数(shu)额与(yu)支付(fu)方(fang)式以(yi)及违反协议的责任。

用工(gong)单位(wei)应当根据工(gong)作岗位(wei)的实际(ji)需要与(yu)劳(lao)务派(pai)遣(qian)(qian)单位(wei)确(que)定派(pai)遣(qian)(qian)期(qi)(qi)限(xian),不得将连(lian)续用工(gong)期(qi)(qi)限(xian)分(fen)割订立数个(ge)短期(qi)(qi)劳(lao)务派(pai)遣(qian)(qian)协议。

第六十条劳(lao)务派(pai)遣单位应当将劳(lao)务派(pai)遣协议的(de)内容(rong)告(gao)知被(bei)派(pai)遣劳(lao)动者。

劳(lao)务(wu)派遣(qian)单位不得克(ke)扣(kou)用工单位按照(zhao)劳(lao)务(wu)派遣(qian)协议支付给被派遣(qian)劳(lao)动者的(de)劳(lao)动报(bao)酬(chou)。

劳务派遣单(dan)位(wei)和用工单(dan)位(wei)不得向(xiang)被派遣劳动者收取(qu)费(fei)用。
